An Empirical Study On The Post System Reform Of The Procuratorate In Wenshan Prefecture

Its prosecutors system is state in the process of a new round of reform of the judicial system is the key of the system.The system is in determining the prosecutor to floor after compiling the proportion of policemen,to perfect relevant supporting measures,make the procuratorial smoothly run efficiently.Prosecutors system by improving the specific number of prosecutors to enter the specific number of the requirements and standards,promoting the development of prosecutors in professional direction.Practice,our country has not specialized law to regulate its prosecutors system,makes the independence of the judicature and the judicial authority of shape is very slow.The prosecutor is the legal position of the constitution and the law of supervisors.Can make the social public prosecutors took system reform consciously abide by the laws,driven by the government in accordance with the law administration,as well as the national safe,healthy and steady development of society.This article adopts the method of empirical study,through field investigation and research on the typical two stage procuratorial organs,prosecutors reform specific data,found problems in the process of reform,put forward the solution,hope to prosecutors took system,in order to realize the judicial independence.Specifically,apart from the introduction to the background,significance,research trends and ideas of the topic,the structure of the chapters is as follows:Chapter I overview of the system of public procurators.First is interpreting the connotation of its prosecutors of system,put forward its prosecutors system concept,and introduced its prosecutors of system reform in China,on the basis of summarizing its prosecutors in the realization of procuratorial system reform team specialization,improve the quality of the prosecutors,improve the efficiency of litigation,implement the responsibility system for justice,and promote the judicial justice,to the town five aspects of meaning.Chapter two:the present situation of the reform of the post system of the procuratorial organ in wenshan state.Through actual investigation of wenshan procuratorial organs(eight cities and counties of a state court)took the implementation of the system reform,including its various cities and counties in the court of limit analysis comparison,in and out of the well conditions,and its standard,the selection process,working mode,professional guarantee five direction after the reform,its analysis of wenshan procuratorial organ of the implementation of the system reform caused the prosecutors case pressure rise sharply,reform of the judicial support staff ratio less than actual,the team is not stable and smooth selection(retribution)committee failed to play a complementary selection(retribution)function,the related supporting measures is not perfect and so on.The third chapter elaborates the conception of the procuratorial post system.Aiming at the problems raised in the previous chapter,the solution is proposed.First is through the normative system of classified management,practice the prosecutors separate position sequence management,perfect the existing examination system,establish a disciplinary mechanism perfecting judicial laws in four directions of the prosecutor management system.The second is to analyze the factors that determine the amount of the district attorney's quota and the proportion of the three types of procurators who are reasonably equipped with two directions.We will establish and improve the mechanism for the selection and withdrawal of public procurators.Finally,from the three directions of authority,identity and economy,the mechanism of protecting the public procurator's job security is guaranteed,and the judicial assistant personnel guarantee mechanism is established to provide the necessary conditions for the smooth operation of the procurator's post.
