Since “strengthening international cooperation against corruption and increasing efforts to recover stolen goods and repatriate them for extradition overseas” was proposed on the Fourth Plenary Session of the 18 th Central Committee of the Communist Party,we've made great process on overseas pursuit.The seriousness of the anti-corruption situation was emphasized again in the nineteenth report of the party.Although China as a whole has made remarkable progress in the pursuit of overseas refugees,in Europe,the situation of China's anti-corruption campaign is still very grim.Extradition refers to a country return person of interest to their own countries on the request of their home countries.Extradition,as an important means of international criminal judicial assistance,plays an important role in overseas pursuits.In Europe,the main obstacle to extradition comes from the European Court of Human Rights(ECHR).As established on the European convention on human rights,the European Court of Human rights shall have the right to sentence extradition guilty.In the jurisprudence of the European Court of Human Rights,the issue of extradition was mainly examined on the issues of the right to life,immunity from torture and the right to a fair trial.In order to realize the successful extradition of criminal suspects from Europe,this article will examine cases of the ECHR,and find out its attitude towards the issues of the right to life,immunity from torture and the right to a fair trial,namely the attitude on issues such as the death penalty,torture,and fair trials combined with the judicial practice of the ECHR.In accordance with the requirements set forth in the jurisprudence of the ECHR,we could draw a conclusion that the extradition requesting country need to make extradition commitment or guarantee that no execution or execution of torture shall be imposed,and build a fair trial system.
