Legal Protection Of Privacy In The Network Environment

According to relevant statistics show that more than seven hundred million mobile phone users in China at the present stage,the website hosting the number are also more than in four million,network throughout the streets,almost everywhere we have almost free wifi,our life is more and more social software,such as live surrounded by software,network also in gradually change the way that we pay,pay treasure,such as WeChat pay mobile payment is becoming more common.Network provides great convenience to our life at the same time because of the network information sharing,and to the public in the collection and dissemination of others privacy under the network environment provides a convenient conditions,breeding ground for privacy infringement problems,human flesh search,spam messages,spam,and so on and so forth.Privacy is a reflection of social civilization,is the proof of the personality independence,but we really feel with the continuous development of network,privacy infringement problem is increasingly serious,compared with traditional privacy infringement problem,today’s Internet privacy infringement problems more quickness and harm are more serious.Therefore,we must attach great importance to the issue of Internet privacy infringement,otherwise it will cause great obstacles to the development of our economy.,however,about the legal protection of network privacy in our country compared with foreign is not perfect,therefore,this paper aims to combine the development status in our country,by exploring the legal protection of network privacy,so as to find a solution to network privacy tort reasonable ways and methods,to reduce the network privacy infringement problems.This paper is divided into five parts.In the first part,the concept,characteristics and contents of network privacy are introduced by the definition of traditional right of privacy,and relevant analysis is carried out.In the second part,the author analyzes the network privacy tort from the main body,the constitutive elements,the performance and the responsibility.The third part mainly discusses the foreign protection mode of network privacy.The fourth part mainly analyzes the current situation and problems of the protection of network privacy in China.In the fifth part,the author discusses China’s Suggestions on Internet privacy protection from the aspects of law,government regulation,industry self-discipline,public awareness and international aspects.
