Legal Regulations For The Formulation Of Local Standards For Production Safety

With the advancement of standardization in the field of safety production,the local standard has become an important way to regulate the daily production and operation activities and to ensurethe development of local economic and social security.During implementation,these standards expose a series of problems which are not good for it to play its role in the standard setting.Based on the investigation of the laws and regulations about the safety standards,the main content of this article is to discuss the legal regulation of standard setting,try to put forward suggestions about standard formulation and its process control.This article contains the following four parts:The first part introduces the basic theory,including the connotation of local standards for safety production,the practice of the development of local standards for safety production,and the necessity of regulating the setting of the standard.The second part discusses the status and existing problems of the law and regulation system of local standard for safety production.Through the practice of production safety in Beijing about city "100 landmark",reveals that project review is not strict,lacking security risk identification mechanismforStandard setting,the standard content is intensely administrative,lacking coordination mechanism in administrative department,lacking quality control.The third part mainly expounds the status of legal regulation of foreign safety production standards and its reference significance.Through sorting out the standardization working mechanism in different countries,the paper summarizes the typical experience and practices,and explores the reference content.The fourth part puts forward specific suggestions.Through the above analysis and review of foreign typical practices,standard setting work should be clearing standards for risk prevention requirements,setting upthe way to the transformation of laws and regulations,strictly controllingconditions for a standard drafting unit,determining the legal status of the coordinating body,improving process control,dividing reasonably the legislative power of the central and local areas,in order to serve the work of standardization of safety production.
