Legislative Suggestions On The Formulation Of An Anti-cult Law

It has been required by The Rule of law strategy that all social relationships shall be adjusted by law.We seek Substantive rule of law,and the quality of law has been carrying much weight.Cult,which as well troubles other countries on this planet,is a serious problem we must face with.The method we choose to deal it will determine what we finally get.Different methods have been taken into practice: the laissez-faire believers focus only on the crime,and don't seem interested in banning those cult groups.Some hold a much positive attitude,which make clear definition on cults,set up ministries,bring up certain regulations,and so on.A third groups escape from facing this problem,which has done nothing but set some special regulations against some special organizations.I suppose that we should take anti-cult legislation in to public awareness so as to perfect The Socialist Legal System with Chinese Characteristics.It corresponds to China's Socialistic nature,as well as China's specific conditions.Anti-cult legislation conform to China's constitution,it is a just,proper choice for this country.This essay is based on this opinion,and consists four chapters.In the first chapter we discuss what is cult,focusing on the characteristics of cult groups.We talk about religious freedom first,making it clear that religious freedom shall not go beyond law.Then,we define cults from three aspects,including the juristic view,the political view and the religious view.At last we come to the conclusion that cult groups do differ from religious groups,religious freedom does not apply to cult groups,on the contrary,cult groups do infringe the freedom of religious believes.The second part concerns the anti-cult regulations in China.In this chapter we overview the history of cults,then we figure out the four new tendencies of cult activities in modern life.The regulations get introduced to the readers soon after the overview,together with their specific characteristics.The disadvantages shall get discussed too,aiming at get them perfected.In the third part we talk about foreign regulations on cults,including the American legislation,the French legislation,the Japanese legislation and the Russian legislation.Based on different specific conditions,the four countries have chosen different methods,and each faces with different difficulties.Their experience shall be valuable references for us.The forth part is my personal suggestions.We discuss the necessity of anti-cult legislation in China,stress its importance to social stability,nation's safety and the Belt and Road project.Then we discuss the feasibility,I believe that the time has come,as all the conditions are all ripe.Finally,we come to the frame of anti-cult legislation,talking about the guiding ideology,the basic principles,and what should be made regulations,hoping that we can make the anti-cult law wise and reasonable.
