Reseaich On Evil Religions' Committing Crime

Nowadays, the world has intensified efforts to fight against cult organizations because they have become the public nuisance to human civil society. According to incomplete statistics, the number of cult organizations and followers has beyond 3,000 and 100,000,000, respectively. Chinese cult organizations, which are represented by Falungong, have jeopardized normal social and legal orders severely in recent years and made fighting to them an important project for national political life. It is also an important task of judicial authority to intensify efforts to fight against those cult organizations. Although origin from different countries, cult organizations have the similar behavior characteristics, such as fraudulence, destructiveness, reactionary and obstinateness, and have the same development tendency to politicization, professionalization, gangdom and internationalization. Cult organizations, not only endanger citizens' body and mind, but also disrupt public orders and jeopardy the stability of society and politics. Incorporating the methods using in cult crime hitting practice and having the cult crime's designating as the main line, we explored the useful inspiration for fighting cult crime in judicial authority practice.Besides the introduction and conclusion, the dissertation includes four chapters:chapter one, a comprehensive review of cult organizations' conception and characteristics; chapter two, an illuminating of the congruence between cult and cult crime and the criminal features of cult crime with the analyzing of cult crimes' criminal theory; chapter three, clarifying and comparing the legislation and practice in legislation and precaution of cult crime between China and other countries in detail, then concluding advanced experiences of criminal laws over the world; chapter four, the emphasis of the thesis, by comparing Chinese and other countries' difference, elaborating the legislation on cult crime of present condition in our country. Although having great efforts on anti-cult's legislation, our country neglected society effect when paying attention to law effect. Integrating china's specific national conditions, we bring forward several suggestions and precaution measures in cult crime legislation from formulating <Counter-Cults Law> and interpreting criminal law 300th.
