In recent years,illegal behaviors of addiction cessation have occurred from time to time in some Internet addiction cessation institutions.Therefore,it is very necessary and urgent to conduct a qualitative study of Internet addiction abstinence behavior from the perspective of criminal law.This paper starts from two practical cases,and discusses the behavior of Internet addiction rehabilitation agencies and their managers separately,combining with the controversial points involved in the case,to study whether their behavior constitutes a crime.On the basis of explaining the basic content of the case and proceeding from the acts of the defendants in two cases,this paper raises the controversial issue of whether the behavior of Internet addiction abstinence constitutes a crime or not,and on the controversial issue,respectively,from the perspectives of abuse of guardians,caregivers,intentional injury,illegal detention,fraud and illegal business operations,and draws conclusions according to different situations.Combining with public opinion,from the two aspects of victim's commitment and the transfer of guardianship,this paper discusses whether there are any factors affecting the conviction and sentencing of Internet addiction abstinence.From the three perspectives of what crime may be constituted,whether there is concurrence or not,and non-conviction,this paper summarizes the qualitative research results of the withdrawal of Internet addiction in criminal law.
