Examples in recent years show that the "works" of AI completely conform to the concept of "works" defined by the existing copyright law without considering the main factors of creation.Therefore,a large number of scholars in the academic circle think that the "work" of artificial intelligence is defined as a work of law with the progress of the times.On this hand,the problem is following.At this time,in the ownership relationship of copyright,the object of the right has been determined,while the subject of the right still has a great controversy.Some scholars believe that the copyright of artificial intelligence works should enter the public directly.In the field,it is free for the public to use,while most scholars believe that reasonable copyright subjects should be set for AI works,so as to better protect AI works by copyright law.Because the creation process of AI works involves many subjects such as programmers,investors,AI managers and users,it is a question which is worthy to further demonstration to ascribe the copyright of AI works to which party.At the same time,with the progress of science and technology,the emergence of new AI simulating human neuron network can AI be regarded as copyright.Subject and existence is also an urgent problem to be solved.Based on the summary of AI works and their forming principles,this paper explains the root causes of copyright ownership problems caused by AI works,draws lessons from foreign relevant experience,and combines with the relevant provisions of the current copyright law,summarizes the factors that should be considered in determining the ownership of copyright of AI works,and puts forward corresponding solutions to determine the current AI.The reasonable system design of copyright ownership of works.
