Research On The Post-legislative Evaluation System Of Local Laws And Regulations

With the continuous improvement of the legal system of building socialism with Chinese characteristics,legal practice is more from how to establish new laws to how to improve the quality of legislation.To improve the quality of legislation,we must start from the most basic and extensive areas.Therefore,the post-evaluation system of local legislation is the most important way and method.All local people’s congresses and their standing committees have carried out some exploratory work on the post-evaluation of local laws and regulations.Although some achievements have been made and it is of great significance to the local legislation and the process of rule of law in China,the post-evaluation of existing local laws and regulations is only at the primary stage,and China has not yet taken it as a normalized institutional mechanism.There is still a gap between them and the actual needs.The purpose of this paper is to start with the theoretical problems of the concept,characteristics,nature and value of China’s post-legislation evaluation system of local laws and regulations,analyze the current situation and existing problems of China’s post-legislation evaluation system of local laws and regulations,and then draw on the advanced experience of foreign countries,as well as the enlightenment to our country,so as to get the perfect countermeasures of the post-legislation evaluation system of local laws and regulations in view of our actual situation.
