On The Improvement Of The Post-evaluation System Of Local Legislation

Post-assessment of local legislation can effectively improve and strengthen local legislative work.Similiarly,it can effectively test the scientificity,democracy and effectiveness of local regulations,regulations and other normative documents.It has played an important role in promoting the quality of legislation and perfecting the construction of the rule.However,the theoretical research and practical exploration of post-legislative assessment are still at the stage of exploration,and no unified institutional norms have been formed.There are still many problems in practice,which affect the post-legislative assessment.In view of the above problems,this paper will combine the practical experience of post-legislative evaluation of local regulations in Lanzhou,refer to the beneficial practices of post-legislation evaluation work in various places,and improve the post-legislation evaluation system.First,explain the basic principles of post-legislation evaluation of local laws and regulations;secondly,analyze the post-legislation evaluation system in the application of system construction and evaluation methods,evaluation object selection,third-party participation evaluation,evaluation report quality,application of evaluation results,etc.Thirdly,it focuses on the analysis of the status quo of the theoretical research after the legislation,the evaluation of the guarantee and supervision mechanism,the post-legislation evaluation of the subject’s awareness of the rule of law,and the post-legislation evaluation of the funding guarantee.Fourth,in view of the existing problems,we should put forward suggestions for improvement from the aspects of improving the initiation procedures,improving the application of evaluation criteria,standardizing the evaluation report format,improving the third-party participation evaluation system,and improving the evaluation supervision and safeguard mechanism,in order to effectively promote local legislation.Institutionalization and normalization of assessment.
