Research On The Issue Of Inmates Being Included In The Social Security System

The 17 th National Congress of the Party pointed out that social security,social assistance,and social welfare should be the basis,basic pensions,basic medical care,and basic livelihood security systems should be required,and philanthropy and commercial stability should be used as an aid to accelerate the improvement of the social security system.It also clearly puts forward the strategic goal of “everyone enjoys basic social security”.The report of the 18 th CPC National Congress further clarified that "we must adhere to the principle of full coverage,basic guarantee,different levels and sustainable development,with the focus on enhancing fairness,adapting to mobility,and ensuring sustainability,and build a comprehensive social security system covering urban and rural residents.".This article believes that the so-called “everybody’s enjoyment” and the “full coverage” of the object of protection are,of course,the general reference to all Chinese citizens.The prisoners are also citizens of China.They have citizenship and should enjoy social security.At present,the reform of China’s social security system is advancing rapidly.The social security system design and safeguard measures for the special group of prisoners are still lagging behind.There is an imperfect legal system,the right to arbitrary deprivation of insurance rights,and the regulations are not comprehensive and unreasonable.Problems such as lack of procedural provisions,these problems can not be resolved,not only affect the protection of the prisoners,but also will restrict the construction of our country’s protection-oriented society.Based on the analysis of the characteristics and content of the social security of prisoners,this article analyzes the necessity of bringing the prisoners into social security from the perspective of human rights and social practice,and summarizes the problems existing in reality through typical cases,and proposes to deal with prisoners.Social security claims.The paper conducts research from the following four aspects:In the first part,we first introduce the research background,the significance of the study,and the status current status of research at home and abroad.In the second part,we define the statutory rights and interests of the prisoners’ social security,and analyze thesocial security of the prisoners in terms of protection objects,safeguard methods,and safeguard contents.The specificity analyzes the current situation and deficiencies of the social security of prisoners in China within the framework of the current system.In the third part,taking the Nanjing prison as an example,it empirically analyzes the legislation and implementation of the social security of prisoners.In the fourth part,aiming at the practical problems and deficiency,we propose to improve the reform direction and countermeasures of the social security system for prisoners in China.This article believes that the inmates are ultimately required to integrate into society,and the reform of prisoners is directly related to the stability of social order.The inclusion of prisoners in the social security system is a guarantee of human rights performance.It is an indispensable requirement for the realization of the basic social security for all,and the comprehensive establishment of a social security system covering urban and rural residents.It is also a good reflection of the superiority of socialism.
