In recent years,terrorist attacks have caused a major impact on the entire human society.All countries in the world have adopted various countermeasures to prevent terrorist crimes.Criminal policies can reflect each country's attitude towards anti-terrorism and various measures taken.The policy documents or the laws and regulations on counter-terrorism can reflect the specific implementation measures of various countries in combating terrorism.In this article,the author conducts a comparative study of criminal policies at home and abroad,and also analyzes China's anti-terrorism legislation,and draws on foreign improvements.This paper is divided into five chapters.The first chapter is about the criminal policy.It compares the general criminal policy with the narrow criminal policy.Then it studies the social importance of criminal policy,and then analyzes the status quo and legislation of international anti-terrorism.It is also proposed that the formulation of the anti-terrorism criminal policy at this stage should be based on the "rule of governance" rather than the "treatment of the standard".Then it expounds the development process of China's anti-terrorism criminal policy,from the germination period before the 97 Criminal Code to the "Criminal Law Amendment(IX)" to the current "Anti-Terrorism Law of the People's Republic of China",which also summarizes the criminal policy of our country.feature.The second chapter and the third chapter study the anti-terrorism representative of the United States and Russia.It expounds the current anti-terrorism situation and legislative status of the United States and Russia,and analyzes the characteristics of the US and Russia's anti-terrorism policies,as well as pointing out the places that China can learn from,and compares them with China's anti-terrorism criminal policy at the end of the chapter.The fourth chapter mainly describes the anti-terrorism status of Hong Kong,Macao and Taiwan in China,and compares the legislative process and legislative content of Hong Kong,Macao and Taiwan regions inChina and the mainland China.The last chapter returns to the defects and perfection of China's anti-terrorism criminal policy.At present,China's anti-terrorism criminal policy has unclear concept definition,imperfect structural system and unscientific penalties.The author combines China's anti-terrorism status and foreign legislation.The situation gives suggestions for reference and improvement measures.
