"Labor contract law of the People's Republic of China(hereinafter referred to as the" labor contract law "),to confirm the labor relations standard from conclude a contract in writing to the actual employment practices,this change will exist in the previous practice of the situation did not sign labor contract into the scope of protection,make a written employment contract is no longer to establish the nature of labor relations standard.Therefore,accurately grasping the connotation and constitutive elements of labor is the key link to identify labor relations.However,although the word "employment" appears in the labor contract law for many times,the law does not further explain "employment".In the academic circle,the research on "employment" is also very rare,and there are few ready-made theories and representative viewpoints.Therefore,the research on "employment" is urgent and important.Specifically,the word "employment" is mainly distributed in chapter two and chapter five in the labor contract law,and this paper discusses the identification of "employment" in general labor relations.
