Research On Legal Issues Of Surrogacy

The application of surrogacy technology makes traditional fertility methods no longer the only way to multiply.However,there is no explicit provision in Chinese laws.Only departmental regulations impose restrictions on medical institutions and medical personnel who implement surrogacy.Surrogacy is given to infertile patients.At the same time it also has a great impact on traditional ethics and civil law theory.How to supervise and control surrogacy is an important issue that we need to solve urgently.Starting from the basic theory of surrogacy,this paper elaborates the characteristics of various types of surrogacy and the attitudes of society to each type of surrogacy,analyzes the advantages and disadvantages of surrogacy from a rational point of view,comprehensively analyzes the three types of typical surrogate regulation models outside the domain,combined with the surrogacy of our country.More than the actual situation and the predicament faced by surrogacy,it is concluded that China should still prohibit surrogacy at this stage.The suggestions for problems of how to determine the effectiveness of surrogacy contract,how to determine the parent-child relationship of surrogate children and how to protect the rights of surrogate parties are made to improve the regulation of surrogacy laws in our country.
