A Probe Into The Legalization Of Same-sex Marriage In My Country

Same-sex marriage is a sensitive hot issue in contemporary society.The phenomenon of homosexuality has existed since ancient times.However,homosexual marriage is hardly recognized.With the progress of the times and rise of diversified values and liberal democracy,more and more countries have realized legitimation of same-sex marriage on the earth.Until 2017,there are 28 countries or regions that have realized the legalization of same-sex marriage all over the world.But in China,there is no law about the same-sex partner at all.To speed up the pace of protecting the legitimate rights of homosexuals and conform to the trend of legalization of international homosexual marriage,actively learning from the advanced legislative experience of other countries should become an important strategy to promote the legalization of homosexual marriage in China.The legalization of same-sex marriage not only concerns the social status of homosexuals,but more importantly,involved a series of rights of homosexuals..It is a great step to protect citizens' rights by law from homosexual love to legalization of gay marriage,and also a major task in the study of human rights in China.Compared with Western countries,the pressure on homosexuals in China comes mainly from the differences between traditional cultures and concepts.However,as the society becomes more inclusive and the awareness of civil rights is unprecedentedly higher,so is the support for the legalization of same-sex marriage.The legalization of same-sex marriage in our country will become more urgent.In addition to the introduction and conclusion,this article is divided into four chapters.The first chapter introduces the overview of same-sex marriage.Through the explanation of the concept of same-sex marriage,the social background,the differences and connections of related concepts,and then introduces the present situation of China's same-sex marriage.All above constitute the basis of this article.The second chapter analyzes the views of Chinese scholars on the legalization of same-sex marriage.Then we analyze the necessity of the legalization of same-sex marriage in China from all angles;What's more,the feasibility of the legalization of same-sex marriage in China is demonstrated from four aspects:the sense of domestic identity,the strong demand of homosexuals,the tolerance of our country's religious beliefs,and the trend of the legalization of foreign same-sex marriage.The third chapter introduces the legislation about the same-sex marriage in the world,and summarizes the legislative models of the three typical countries.These countries include Canada,the United Kingdom,France.We also analyze these three models,and generalize the experience that can be used for reference in our country.The fourth chapter suggests that China adopt legislation model of "same-sex partner"in Britain.Then we put forward the idea of establishing the same-sex partnership law,which including the establishment conditions of the same-sex couples,the content of the right of identity,property rights and the adoption of children.
