Research On The Qualifications Of Adopters In The Adoption System Of Our Country

The adoption system is an important part of the marriage and family system and plays an irreplaceable role in real life.As one of the important subjects in the adoptive relationship,the study and improvement of the adopter directly determine the realization of the purpose of the adoption system.Adoption has existed since ancient times.In 1991,the adoption law of the People’s Republic of China was enacted.But with the development of social economy,the current adoption law increasingly exposed many malpractices,the regulations of the adopter qualification does not favor the adoption of the implementation of the system purpose,cannot completely meet the need of modern society to adopt,also make the law of value realization is in control,in the change of the adopter qualification for adoption system is imperative.This paper is divided into four parts:The first part is the introduction,which mainly points out the raising of the adopter’s qualification,introduces the value and significance of studying the adopter’s qualification in the adoption system,and makes a simple analysis of the legislation and theoretical research on the adopter’s qualification in China.The second part is an overview of the adopter’s qualification,which introduces the concept of the adopter’s qualification,the origin and development of the adopter’s qualification in the adoption law of our country,and analyzes the legislative trend of the adopter in modern international society.System of the third part through the adoption of legislation about the adopter qualification analysis,expounds the legal system of our country adopt the adopter eligibility problems,through in-depth study the regulation of our country the adopter qualification,points out that under the current adoption law system in China about the defects of the adopter qualification,mainly in the adopter age,the number of adopted children,adoption ability definition,adoption of qualification examination and dynamic supervision of the adopter qualifications existence insufficiency.Fourth part our adopter qualifications according to the third part of the relevant provisions of the defective problem put forward Suggestions of perfecting our country’s the adopter eligibility,such as clear according to the adopted children subject conditions,reduce the adoption of the lowest standard of the age,reasonably adjust the adoption of quantitative restrictions,to adopt the ability to do comprehensive evaluation and improvement of the adopter qualification examination and dynamic monitoring.
