Since The 18th National Congress Of The Communist Party Of China, The Study Of The Behavior Of Normative Subjects In The Construction Of Internal Laws And Regulations

At present,the studies of Party regulations mainly focus on the abstract interpretation of relevant concepts and specific documents of Party regulations from the perspective of jurisprudence.Few of these studies systematically analyzed the relationship between Party regulations and subject behavior from a histological perspective and theory of histology.Therefore,this paper makes a dynamic analysis of the Party regulations revised since the 18 th National Congress of the Communist Party of China(CPC)from the perspective of histology,in order to find out the internal logic of the Party regulations regulating the subjects behavior and the basic principles for their function realization.Based on the above understanding,this paper is divided into three parts.The first chapter conducts a comprehensive literature review on the studies of Party regulations and the normative subject behaviors of Party regulations.It also makes a comparative analysis of Party regulations and national laws,CPC's system,inner-party normative documents and party discipline,so as to better understand the connotation of Party regulations.Party regulations and national laws belong to different normative fields and can complement each other to some extent.Party regulations are included in the CPC's system;Party regulations are more stable than inner-party normative documents and stricter in the formulation procedures.Written party discipline inevitably takes the form of Party regulations.The second chapter to the fourth chapter mainly analyze the basic logic of the Party regulations regulating the subject's behavior.Exercising full and strict governance over the Party has become the basic starting point for Party regulations to regulate the subject behavior.Since the 18 th CPC National Congress,Party regulations have required that the code of conduct of Party committees,Party organizations,commissions for discipline inspection,discipline inspection,and primary-level Party organizations comply with the basic logic of“regulating the subject”,“regulating the behavior”and“regulating the supervision”.In terms of standardizing the behavior of party members,emphasis should be put on improving the quality of party members through macro-level structural control and strict development procedures of party members,and strengthening the construction of party members' subjectivity based on obligations and rights,so as to strengthen the regulation of party members' behavior.On the one hand,we need to give priority tointegrity,and require the Party officials be loyal to the Party,have moral integrity,and demonstrate a keen sense of responsibility.On the other hand,we need to establish strict and fair promotion mechanism to encourage Party officials to work actively and strengthen their sense of responsibility.The fifth chapter is a summary of the Party regulations to effectively regulate the subject behavior.Systematic Party regulations should stick to the principle of effective cohesion between Party regulations and national laws,the principle of systematic and scientific Party regulations,and the principle of dynamic adjustment of Party regulations.
