An Analysis Of The Supervisory Procedures Of The National Supervisory Committee

At present,China's supervision system reform has been preliminarily completed,but the content of its system design has not been perfected.Afear a year of pilot regional reform,a lot of problems of the Supervisory Commttee has arose.Supervision,as the most important function of the Supervisory Commttee,Implementing the functions of daily supervision and special supervision.The exploration of the meaning of the supervisory function and the supervisory procedure will be of great significance to the institutional study of the Supervisory Commttee.This paper attempts to combine the practice of the supervisory procedure in the pilot areas with the relevant normative documents to analyze problems in the supervisory procedure,clues and unreasonable procedures,difficulties in implementation,insufficient construction of the procedural transparency mechanism and lack of supervisory mechanism,and the relevant measures to improve the supervision procedures.In addition to the introduction and conclusion,the main content of this paper is as follows:Part ?:First,to define the relevant concepts of supervisory procedures,focusing on the meaning of supervision and the content of the supervisory procedures discussed in this article,and then combing the existing provisions on the supervisory procedures,including the "Supervision Law" and the Central Commission for Discipline Inspection issued the relevant provisions on disciplinary supervision.By clarifying the existing provisions of the supervisory procedures,it is intended to find that the current supervisory procedures focus on supervision procedures and implementation of a wide range of the characteristics of supervision.Finally,according to the procedure has the internal and external value,the supervision procedure exists intrinsic value and the external value,the intrinsic value contains to ensure the supervision organ to carry out the fair and orderly implementation and the effective supervision work.External value lies in helping to construct the system of supervision and restriction of state power.Part ?:Through the analysis of the insufficiency of the legal system and the problems arising in the operation of each pilot,the author draws the conclusion that the supervisory procedure of the Supervisory Commttee has such problems as vague clues disposal procedure,insufficient construction of supervision team,and insufficient supporting system of other procedures,and analyzes the causes of many problems of appeal from the macroscopic system and practice,and points out that it should be perfected in many aspects such as the construction of the procedural system and troop construction.Part ?:In view of the above issues,put forward specific recommendations.First of all,we should construct the problem clue disposal program in the supervision procedure scientifically and rationally manage the problem clue.Secondly,it proposes to solve the problem of practical implementation in the supervision of the Supervisory Committee in order to achieve the implementation of the safeguards procedure.Including two measures:First,to enhance the supervision of the professional quality and implementation capacity;Secondly,the paper puts forward the transparent mechanism of supervising and implementing the supervision procedure.Finally,it is suggested to strengthen the supervision means of supervising procedure and to build two kinds of supervision methods of self-monitoring and external supervision.Self-supervision mainly includes the internal professional supervision departments and internal departments of the work of the Division of labor and control mechanism.The external supervision should quicken the construction of the concrete feasibility of the supervision of the the National People's Congress,construct the transparent mechanism of supervision and feedback channels,so that the social citizens'supervision and effectiveness should be maximized.
