With the advent of the "Internet plus" era,the Internet has played an irreplaceable role in all aspects of our lives: we can freely access information we want to know on the Internet platform,or even get the latest information at the first time.Moreover,people can also communicate with each other on the Internet to truly realize "confidant in the sea,if the horizon is adjacent to each other".But while we are enjoying the dividend brought by the Internet,we have to be vigilant about its negative impact on us,such as all kinds of infringements,even criminal acts become more unbridled with the help of the network environment;while the network provides social software,access to information and other convenient services,on the other hand,it inevitably becomes the breeding of infringement.As a hotbed of criminal acts,cyber crime cases are also increasing year by year.Among them,network defamation,as a typical network crime,will not only damage the reputation of others,but also cause serious social problems and disrupt social order in serious cases.Therefore,in contemporary society,online defamation is a major issue that we must pay attention to.Therefore,how to take effective measures to crack down on online defamation in criminal law regulation is a problem worthy of our in-depth consideration.The article will be divided into five chapters to elaborate the criminal law regulation of online defamation in China.The first chapter briefly introduces the background and significance of the criminal law regulation of cyber defamation,and briefly introduces the research status of the criminal law regulation of cyber defamation at home and abroad,and elaborates on the research methods of this issue.The second chapter gives a brief overview of cyber defamation,and combs the similarities and differences between its concept and characteristics and traditional defamation.Finally,the harm of network defamation is summarized,and then the necessity of criminal law regulation is extended.Chapter three introduces the current situation of criminal law regulation of network defamation in our country,analyses its advantages,and lists the difficulties and shortcomings in the process of criminal law regulation of network defamation in our country.Chapter four is based on the current criminal law regulation of network defamation in our country.The predicament and deficiency of the existing criminal law regulation of network defamation in foreign countries are simply sorted out and its advantages are found out,which are worthy of learning and learning from theInternet countries.The fifth part,that is,the last part of the article,clarifies the predicament and deficiency of the current criminal law regulation of network defamation in our country,and makes a good or bad comparison with the criminal law regulation of network defamation in foreign countries.Comparing with the latter,this paper puts forward some corresponding measures to improve the current criminal law regulation of online defamation in order to regulate online defamation more comprehensively and completely in our country.
