Research On Several Issues Of Administrative Public Interest Litigation In My Country

With the development of social economy,the administrative power of China’s administrative organs has expanded continuously,and it has penetrated into all aspects of civic life。 It is true that the expansion of administrative power has brought a lot of convenience to our lives,but at the same time we should also see that The possibility of infringement of the public interest has become higher,and the current traditional litigation form in China has not been fully compatible with the new litigation request。After a long process of development,the administrative public interest litigation system has finally been recognized in China,and it has been clearly stipulated in the Administrative Litigation Law。 Based on the current development of China,further optimization and improvement of the current administrative public interest litigation system is the need to improve the administrative litigation law,and it is also the need to protect the public interest of the society,and it is also an inevitable requirement for promoting the administrative organ according to law。 A lot of theoretical foundations and practical experience have been provided at home and abroad on how to improve China’s administrative public interest litigation system。 In the discussion of this paper,it is divided into four parts to study the problem of administrative public interest litigation in China。 Starting from the basic concepts and theories of administrative public interest litigation system,the paper analyzes the current legislative situation of administrative public interest litigation system in China。 At the same time,it briefly introduces the specific implementation of relevant laws,then analyzes the theory and practice of the administrative public interest litigation system in extraterritorial countries,explores the reality of China,and finally proposes how to improve China’s administrative public interest litigation system.
