Research On The Legal Issues Of The Transfer And Transformation Of Service Inventions In Chinese Universities

As a place of research and development,the university is a place where the research and development personnel of service inventions should be the place where the service inventions are prosperous and promote the development of science and technology.However,the situation of job inventions in colleges and universities in China is not ideal.The number of applications for job inventions in colleges and universities is quite different.Some universities have not applied for service inventions,and a large number of university service inventions have been put on hold,and the transfer conversion rate is low.The service invention can only realize the value of the service invention by transferring and transforming the service invention into the market and putting it into production.In this regard,China has also taken some measures,such as the introduction of the Law on the Promotion of the Transformation of Scientific and Technological Achievements and the Implementation of the Law on the Promotion of the Transformation of Scientific and Technological Achievements,which gives universities the right to autonomously dispose of service inventions in order to promote service inventions.Transfer conversion.However,its effectiveness is not large,and it does not take into account the root causes of the large difference in the number of applications for university service inventions and the low conversion rate.What caused this dilemma? What measures should be taken to increase the number of applications for job inventions and transfer conversion rates? These issues are worth studying.Based on the effective legal system and the basic theory of intellectual property rights in China,this paper analyzes the causes of the dilemma of transfer and transformation of university service inventions,and draws on the regulations of the transfer and transformation system of service inventions in universities outside the country,and then proposes to improve the transfer and transformation system of service inventions in China.The proposal is to increase the number of application for service inventions in colleges and universities,transfer conversion rate of service inventions,avoid waste of resources,and promote the development of science and technology.The article is divided into five parts: The first part is the introduction,which is mainly from the background and significance of the article,the article ideas and innovation points;the second part mainly describes the basic concepts and theoretical basis related to the transfer and transformation of service inventions.The following is the theoretical support;the third part analyzes the causes of the dilemma of the transfer of university service inventions,which mainly comes down to the requirements of the service invention rights and the nature of the university itself.The fourth part analyzes the measures taken by China against this dilemma.The problems and their existing problems and the enlightenment of the extraterritorial system to China;the fifth part is aimed at the causes of the dilemma and the analysis of the current situation of colleges and universities in China,and puts forward suggestions for perfecting the transfer and transformation system of the service inventions in China.
