At present,due to the characteristics of virtuality and variability of the network,online operators' credit rating has become an important reference factor for consumers when making online shopping transactions.The proper credit evaluation can objectively reflect the transaction profile of network operators,restrict the behavior of online trading entities,reduce the risk of online consumers' transactions,and then build a fair and orderly online market competition environment.This is a continuous and benign development of online shopping.Helplessness;unfair credit evaluation behaviors,such as false positive reviews,brush credits,malicious bad reviews,etc.,not only undermine the interests of online consumers,adversely affect other law-abiding operators,but also undermine the normal order of competition in online transactions and The integrity system is not conducive to the development of the online trading market.In this regard,we need to further improve the relevant laws in our country and regulate the endless number of improper credit evaluations.With the rapid development of network information technology,more and more new types of network unfair competition behaviors that differ from the traditional original market emerge in the network market competition.The credit evaluation system in the C2 C model also suffers.The interests of some of the business operators are tainted and violate the rules of competition,causing harm to other operators and consumers,thereby undermining the order of competition in the online market.However,due to the imperfection of relevant laws and regulations in China,the rapid development of the network economy has brought great impact on the relevant laws in China,which need to be improved and perfected.By analyzing the deficiencies and unfair competition in the credit evaluation system of C2 C model in China,and combining with the legal basis for its regulation,this paper puts forward feasible legal regulation ways.There are still many defects in the legal regulation of credit evaluation behavior in C2 C model of network transactions in China: problems in the legislative regulation of unfair credit evaluation behavior;imperfect supervision mechanism of administrative law enforcement;difficulties in protecting consumers' rights infringed by unfair credit evaluation behavior,etc.Through the study of the relevant legislative experience of Germany and the United States,and combining with the actual situation of China,the following suggestions are put forward: to improve the relevant legislation on the regulation of unfair credit evaluation of network transactions;to construct and improve the legal mechanism of law enforcement and supervision;and to improve the judicial regulation of unfair credit evaluation of network transactions.
