Research On The Legal Liability Of Unfair Competition

Unfair competition is one of the inevitable results of economic development.In recent years,China's market economy has been developing rapidly,the market system has become increasingly complete,and market competition has become increasingly fierce."Anti-unfair competition law",in contrast,normative ACTS of unfair competition,law enforcement and legal responsibility with the real economic life,there are significant exposed some problems,such as the lack of maneuverability,the new ACTS of unfair competition in economy lack of careful specification,caused the investigation of ACTS of unfair competition,to a certain extent,affected the normal market economic order,and this situation makes the perfect anti-unfair competition law is imminent.Anyway,if you want to be able to effectively implement,anti-unfair competition law,first is to implement the system of anti unfair competition law responsibility,had the complete legal responsibility system,to get through the market competition main body,thereby reducing the occurrence of ACTS of unfair competition,in addition,if the ACTS of unfair competition has produced adverse consequences,to perfect the legal liability system also helps to relief victims,so as to realize the legislative purpose of anti-unfair competition law.This paper consists of four parts.The first part elaborates the definition of unfair competition and common forms of expression of existing theories.The second part establishes the legal liability system and legislative model of unfair competition,which lays the foundation for the following studies on various forms of liability.The third part and the fourth part respectively discusses the administrative responsibility,the theory foundation and the concrete setup of the unfair competition behavior.By reflecting on the legal liability system of unfair competition in China,we hope to perfect the legal system of administrative liability and strengthen the role of civil liability in the field of unfair competition,so as to better adapt to the development needs of contemporary market economy.
