The Internet technology continues to grow and has penetrated into every area of people's daily lives.In the context of the information age,it is an objective fact that people can enjoy various conveniences,and at the same time,the impact of traditional concept rights and interests is inevitable.A large amount of data collection,analysis and storage in cyberspace has surpassed people's imagination.The development of information technology makes it easier for people to obtain corresponding information,and it also makes our information less difficult to obtain by others,which will inevitably increase the difficulty of protecting citizens' privacy rights from infringement.To this end,in order to effectively protect citizens' right to privacy and its related economic interests,citizens must be given a certain degree of discretion over their personal information,especially for information that is not conducive to the future development of all parties.Based on this,the concept of “right to be forgotten” was born.If the traces of a person's past are tied to them forever,then the "forgotten" appeal is particularly valuable.Starting from the right of consent,a set of personal data rights ending with the right to be forgotten is based on the concept of “personal information autonomy”,which embodies a high level of individual rights protection and is a legal response to the possibility of information technology infringement.This article first discusses the right to be forgotten and the corresponding problems,and elaborates on the development process and characteristics of the power.After that,it analyzes the rights subject and obligation subject under the system of forgotten rights,as well as the elements of legal relationship such as object and content,and discusses its normative role in protecting personal network information.Finally,learn from and draw on the mature practices accumulated by the Western countries represented by the EU in this field.On this basis,combined with the reality of our country,propose a unique path to establish the right to be forgotten.
