The Rohingya refugee issue has emerged under many factors and has had a considerable impact on neighboring countries.It not only has become the focus of debate between Bangladesh and Myanmar,but also is seriously affecting bilateral relations and multilateral relations.Under the International Refugee Law System,the 1951 Convention relating to the Status of Refugees and the 1967 Protocol relating to the Status of Refugees are the main conventions on the protection of the rights of refugees,which are applicable to Rohingya refugees.When the definition of refugees is satisfied under 1951 Refugee Convention,Rohingya refugees should enjoy refugee treatment and states should follow the important rules of refugee law such as the principle of non-refoulement.In addition,there are important conventions about human rights that are applicable to Rohingya refugees,in which the humanitarian principle is important.UNHCR,ASEAN,and other human rights organizations or institutions also play a very important role.Under the international criminal law system,the International Criminal Court has already ruled on the case that the Rohingya people were expelled by the Burmese authorities.The prosecutor began the preliminary investigation procedure,and the individuals responsible for the expulsion,who represent for the Myanmar authorities not only meet the criteria of constituting crimes against humanity,but also act as genocide.They need to bear the corresponding criminal responsibility.However,the investigation procedure of the International Criminal Court in this case is still in progress,and the final influence that can be exerted is still unknown.There are some problems with the protection of Rohingya refugees in the above-mentioned system,including the lack of absolute commitments in international law,the absence of ASEAN on the Rohingya refugee issue,and the limitations of the International Criminal Court on jurisdiction and accountability.To solve these problems,ASEAN must perform in a better way under the existing refugee protection system,and the influence of the International Criminal Court needs to be enhanced.Moreover,International Court of Justice can be introduced in the Rohingya refugee problem.
