Research On The Legal Issues Of My Country's Blockchain Platform

At present,blockchain is in the initial development and application of the explor ation stage.The first is the development of bitcoin and other digital currencies,and t he financial applications triggered by bitcoin far exceed those of other industries.Ther efore,there are many literatures about the application of blockchain technology and bl ockchain in the financial field,and few literatures about the research of blockchain pl atform.However,as an intermediate link between blockchain technology and specific application of blockchain,blockchain platform is indispensable,and the legal problems caused by blockchain platform are the most significant.Therefore,the current researc h on the legal issues of blockchain platform has important practical significance for t he better development and application of blockchain.In addition to the introduction and conclusion,this article consists mainly of four parts: the section one mainly discusses blockchain and blockchain platform.Including the definition and characteristics of blockchain,the meaning and composition of bloc kchain platform.The second part mainly expounds the legal problems existing in the blockchain platform.The main contents are as follows: there are three problems withi n the blockchain platform,namely,information security risk,difficulty in responsibility allocation and difficulty in user rights and interests relief.There are two problems o utside the blockchain platform: lack of supervision system and frequent occurrence of illegal and criminal phenomena.There are also contradictions between the decentraliza tion of the platform and the legal supervision,as well as conflicts between the techni cal specifications of the platform and the legal specifications of the blockchain platfor m.The third part discusses the reference of foreign regulatory legal system of blockc hain platform.The main contents include: referring to foreign regulations on the distri bution of responsibilities of participants and the relief of users' rights and interests wi thin the supervision of blockchain platform;Learn from foreign countries on the super vision of blockchain platform external regulatory system,criminal regulation system.T he fourth part puts forward some Suggestions for improving the legal problems cause d by the blockchain platform in detail.The main contents are as follows: Suggestions for improving the internal problems of the blockchain platform are to guarantee the i nformation security of the platform,clarify the distribution of legal responsibilities of the blockchain platform,and improve the rights and interests relief system for the platform users;Suggestions to improve the external problems of blockchain platforms are to build laws and regulations to supervise blockchain platforms and to improve the l aws and regulations on illegal crimes of the platforms.We should also balance the c ontradiction between decentralization and legal supervision and correctly handle the co nflict between technical norms and legal norms.
