The Ethical Controversy And Reform Suggestions Faced By The Death Penalty System

As a kind of penal system that is almost a long-lasting existence,the death penalty has always been a very important part of the penal system.Most countries today have abolished the death penalty,and our country not only retains the death penalty,but also applies it more widely than other countries.Therefore,this paper conducts an in-depth ethical analysis on the issue of the death penalty and the death penalty in China,which enables people to understand and rationally treat the penalty system of death penalty,so that it can better serve the people and guarantee social order stable.This paper first analyzes the development of the death penalty in China,and compares the death penalty system of several major developed countries,and discusses the main arguments of the death penalty and the abolition of the death penalty.As a research background,it lays the foundation for research.Secondly,the death penalty is abolished.The theoretical analysis of ethical controversy,combined with human rights theory,justice theory and utilitarian theory,explores the concept of retribution in Chinese traditional culture,the effect of deterrence,the crime of cautious murder and the manifestation of the idea of harmony between man and nature in the death penalty system.Basic theoretical foundation;Finally,under the support of research background and ethics-related theories,from the aspects of life values,human rights awareness,social development conditions and the social functions they play,the ethical analysis of the death penalty in China.From the perspective of the table and the inside,from the outside to the inside,analyzing the development status of the current death penalty system in China,the underlying reasons and the multiple considerations of the current system setting,the paper puts forward the ethical principles of establishing the values of respect for life and establishing the reform of the death penalty system.Appropriately adhere to the death penalty,actively promote the appropriate reform of the death penalty based on ethical requirements,and strengthen the professional ethics of legal practitioners.The research intends to clarify that only by putting the death penalty system between various factors of society and paying attention to its interaction and mutual influence with other factors can we draw reasonable and realistic conclusions about the death penalty system;and based on China's national conditions,weshould adopt a gradual approach.The way to steadily advance the reform of the death penalty,retaining the death penalty and strictly restricting the death penalty is a realistic choice for contemporary China.
