A contract is an agreement recording the rights and obligations of two parties.It comes about as a result of social progress,Its development has gone through a long historical process.There is no doubt about the importance of contracts in human social life,Human beings communicate by contract to allocate their rights and obligations to each other.Through the investigation of the loan contract in tang dynasty,we can see that in the traditional agricultural society of the tang dynasty.As the gap between rich and poor continues to worsen and overall productivity shrinks.Private lending has become an indicator of people's livelihood and social order,It is also an important part of social and economic life.The private loan contract has a long history and has been developed and perfected in several dynasties.Loan demand is increasing,loan ethos is more prevalent.In order to prevent the borrowing behavior from causing financial crisis,the tang government had to make a lot of laws and regulations to regulate it,and tried to bring it under its control.For example: loan contract form,content,interest,performance,breach of contract liability.Taking the loan contract system in the tang dynasty as the research object,this paper summarizes the types and characteristics of the loan contract in the tang dynasty by introducing the basic situation of the folk loan in the tang dynasty,analyzes the key regulations of the tang law on the loan contract,and summarizes the historical effects of the relevant legal regulations in the tang dynasty.Finally,it summarizes the influence and enlightenment of many legal regulations on folk lending in the tang dynasty on later generations,so as to provide useful Suggestions for the legislation of modern folk lending.
