An Inquiry Of The Contract Law System Of Tang Dynasty: Bases On The Dunhuang Ancient Contract Materials

This is a dissertation of study on the Ancient Dunhuang contract in Tang Dynasty, which relies on the local excavation of Dunhuang contract, by comparing with the law code and principles of Tang Dynasty, the author tries to make some integrated description of the contract system in Tang Dynasty. On the components of this dissertation, in the beginning the author dissertates the evolution and key issues of the Chinese ancient contract, the issues of the Chinese ancient contract are, pursuing the value of harmony with the Tian spirit, spirit of making a deal ,trust and honesty . All of the issues urge people to fulfill the contract and becoming the moral foundation of fulfilling a contract. By different reasons of commercial action, the author sorts the contract in 6 types, the author dissertates the different periods of fulfilling a contract, which contrasts the law code and principles of Tang Dynasty, on the actually fulfilling of the system of law code and principles of Tang Dynasty, the author dissertates there is rigid and custom Law influencing the actual system of contract of Tang Dynasty.
