Research On The Social Support System For Juvenile Procuratorial Work

The social nature of the problem of minors determines that its effective solution must rely on a professional and developed social support system.Through the special and professional services provided by social forces,judicial organs can effectively bear the responsibility of guiding,educating and correcting minors,and help them to return to society smoothly.As the national legal supervision organ and the only political and legal organ participating in the whole process of minors' judicial protection,the procuratorial organ has the responsibility to undertake the task of constructing the social support system for minors' procuratorial work,to explore the development path and mechanism in depth,and to strive to achieve the effective connection between minors' judicial and social participation.Although the pilot work is being carried out in an orderly way,we have to admit that the academic research on the basic theory in this field is not deep enough,and the practical experience is not enough,and there are many problems to be solved.It is based on this,this article from the theory and practice of two-way,combined with foreign and local practical experience,to explore the effective construction of minors' procuratorial work of social support system initiatives.In the first part,the author starts from the concept,system structure,concept and importance of the social support system of juvenile procuratorial work,and deeply studies the theoretical basis of the social support system of juvenile procuratorial work.In the second part,through the investigation of the development process,experience and current situation of juvenile justice socialization in Italy,Japan and the United States,on the basis of following the objective law of juvenile justice,the author summarizes the excellent practices that can be used to construct the social support system of juvenile prosecution in China.The third part is based on the practical achievements of the procuratorial organs in China,and analyzes the situation of juvenile judicial social governance.In order to explore the construction path in line with China's national conditions,the paper analyzes three local excellent practice samples: the establishment of critical prevention mechanism in Ziyang,Sichuan Province,the establishment of protection punishment system in Jiading,Shanghai,and the implementation of case management in Weifang,Shandong Province.The fourth part from our country concrete practice situation embarks,summarizes the construction minor procuratorial work social support system urgently needs to solve the question,thoroughly solves the development predicament.In the last part of the article,based on the previous research and discussion,the author puts forward the ideas and ideas of constructing the social support system of juvenile procuratorial work:firstly,clarifying the legal status and responsibilities of juvenile prosecution social workers from the system;secondly,building a juvenile service platform to promote the smooth flow of information and form a pattern of multiparty interaction and exchange.Thirdly,we should promote the standardization and professionalization of juvenile procuratorial social work and further improve the degree of professionalization;fourthly,we should smooth multi-channel capital inflow,establish and improve the feedback mechanism of evaluation,and promote sustainable development;fifthly,we should put forward further requirements for the procuratorial organs to implement the social support system for juvenile procuratorial work.Effective and produce expected results.The fourth part summarizes the problems that need to be solved in order to solve the development dilemma.The author hopes that through the above research,we can put forward some suggestions with certain theoretical significance and practical application value,so as to realize the effective connection between juvenile judicial protection and social participation.
