Research On The Protection Of Children's Rights And Interests In My Country

With the rapid development of children's model market,many parents lead their children to enter this field,their original intention is different,or "aspire to be a dragon,hope a girl become a chicken",or just to make a profit.Due to the lack of industry regulation and special legislative protection,many parents lose themselves in the face of the temptation of interests and infringe on the rights of children's model to receive education and rest.Employers pursue profitability and treat child models as adults,arranging work to ignore child model rights.Therefore,Hangzhou BinJiang District issued the country's first child model protection regulations," Opinions on Regulating Child Model Activities to Protect the Legal Rights and Interests of Minors," to regulate child model activities,and to regulate child model activities and protect the rights of child models.However,there is still a problem of application in judicial practice.The definition of child labor is single,preschool model rights and interests can't be effectively protected;There are some problems such as limiting the rights and interests of child models,lack of relief mechanism for guardian infringement,and lack of supervision and management.In this regard,we should improve the legislative protection on the basis of the existing child model protection and specify the working time of child model,define child labor from the perspective,and include preschool child models in the legal protection;relax the age limit of child model endorsements,change the protection perspective,and protect the rights of child models from infringement by supervising and regulating employers' behavior,rather than adopting restrictions on child models Methods to protect the rights of child models;and take preventive measures against guardians to reduce the infringement of the rights of child models from guardians.Finally,we must set up a special agency to strengthen supervision and management to effectively protect the rights and interests of child models and create a good environment for child models,So that they can grow up happily and develop healthily.This article is divided into four parts.The first part mainly introduces the current situation of infringement of the rights and interests of children's models inChina and the current situation of legislation,and points out the necessity of protecting the rights and interests of children's models in China.The second part is a reflection on the existing legal provisions.There are deficiencies in the mechanism in practice.The third part is to sort out the legal systems and related regulations of developed countries taking the United States and Japan as examples,and provide some reference for the improvement of China's child model protection mechanism.The fourth part tries to put forward some opinions and suggestions on the existing child model protection mechanism to improve the protection of child models.
