| Public intervention as part of Child Protection System is a common trend in contemporary public protection mechanism for children. It applies legal infrastructure in the children protection. State becomes ultimate responsible protector for children, on the basis of which systematic protection systems get established. Now most countries in the world are dedicated in their endeavor to protect children’s interest, building comprehensive guardian protection systems. This in effect turn the children protection and guardianship from a domestic matter into a public one.Current family based traditional guardianship system in China has become increasingly insufficient, especially in the absence of public intervention and involvement. The current law systems is lagging behind the actual society need. The absence of the State as protector and guardian, and the lacking in public intervention procedure have led to in-action in the face of a number of cases. Precaution and remedy measures could not be derived effectively. Children are under no protection effectively. The public intervention in children protection and guardian should ideally increase gradually. Efforts must be made to strike the balance between domestic and public domains. Based on systematic regulations and mechanisms, the State responsibility must be confirmed for all those children without legal or effective guardian. China should recognize this society development need, to strengthen the public intervention role in protecting children, to establish the comprehensive legal systems and public administration systems. The sufficient response to the society need is an imminent call for action from the State.This article starts with highly focused cases, to identify existing problems in children protection. It will focus on the necessity for public intervention, to explore the means for system development. It hopes to contribute to establishing guardian systems to better protect and support children of this country. |
