The Evolution Of EU Foreign Investment Security Review Laws And Its Lessons For China

Economic globalization makes the production and business activities of various countries form closer integration through the world market,improves the economic connection and dependence of various countries,and makes the allocation of resources more extensive.As the realization path of economic globalization,economic globalization drives transnational investment,which also promotes economic globalization.With the implementation of the "going global" policy,the overseas investment activities of Chinese enterprises have developed rapidly.While absorbing a large number of foreign capital,foreign capital mergers and acquisitions bring advanced science and technology and management experience;At the same time,it may lead to the concentration of market forces,seriously hinder the effective development of the market economy,and may control the key areas,thus threatening the national economic and industrial security.The eu has established an anti-monopoly review system to tighten foreign investment policies at the eu level,and China should actively respond to this by improving the security review system for foreign investment and promoting China-eu BIT consultation and negotiation.This paper is divided into four chapters,the main content is:The first chapter mainly sorts out the evolution of the security review of foreign investment in the eu.The introduction of the Lisbon treaty enables the eu to acquire the exclusive jurisdiction of FDI and entrusts the eu with the legal status of conducting the security review of foreign investment.At the same time,this paper analyzes the background of the regulations on foreign direct investment examination of the eu,and briefly analyzes the background of the regulations from economic,political and other aspects.The second chapter introduces the eu national security review system,and analyzes and evaluates the review system from the aspects of review subject,scope and procedure.The third chapter mainly reviews the establishment and evolution of China's foreign capital security review system,and puts forward Suggestions for improving the current situation of China's foreign capital security review system.At the same time,it analyzes the influence of the establishment of the eu's foreign investment security review system on the sino-eu BIT,and puts forward the direction that China should make efforts in the negotiation to expand the scope of investment cooperation between the two sides.
