Research On The Legal Regulation Of The Public Security Agency's Network Public Opinion Supervision

Recently,with the popularization of the Internet,WeChat,MicroBlog and other network platforms,in which many hot topics and discussions born,have already become the center of public opinions.As the administrative department of internet public opinion guidance and management,which also assume the investigation and evidence collecting of internet crime,public security organs must rapidly strike false reports and resist rumor spreading,to maintain the stability of the network order.The right to monitor,guide,control and dispose of internet public opinions,not only determines the important position of public security organs,but also show the shortcomings appearing in the practice of legal means.This paper includes four parts that discuss the legal regulation of internet public opinion,and putting forward the suggestions of reforming ways through combining the national conditions.The first section gives the meaning and definition of Internet public opinion supervision,which presents the summary of Internet public opinion and Internet public opinion supervision.The second section of the paper analyzes the present situation of internet public opinion supervision,which based on supervision duty and basic factors of public security organs,introduces surveillance's subjectand object,content.It demonstrates the supervision duty of public security organs,separately describing the internet public opinion monitoring,the analysis and study,the Internet public opinion leading and guidance,striking the network crime.The third part is the analysis of the problems and causes of public security organs' network public opinion supervision.First,analyze the problems existing in the supervision of public opinion by public security organs on the Internet,including disregard for citizens' rights,anomie of administrative law enforcement power,and easy handling of public opinion by external interference.Secondly,analyze the reasons for the above problems,including the weak awareness of the rule of law of public security supervisors,the lack of sound laws,and the lack of effective supervision and control mechanisms.The fourth part is the countermeasures to solve the public security network public opinion supervision problem.First,form a general awareness to protect citizens 'speech,including: guaranteeing citizens' freedom of speech,the right to know,and the right to supervise,etc.;second,to improve relevant legislation on Internet public opinion supervision,including: formulating basic laws on Internet public opinion supervision,and implementing network public opinion supervision Legislation of procedures,clarify the authority of public security organs to supervise public opinion,and so on;third,improve the supervision andrestriction mechanism,including: the establishment of internal supervision mechanisms of public security organs,and strengthen social supervision.
