China is in a period of rapid economic development,people's living standards are increasing day by day,but the phenomenon of untrustworthiness has occurred frequently.Out of the practical needs of maintaining steady economic growth and long-term social stability,China gradually develops a social credit system and maintains a good credit order.Through a series of meetings of the 16 th and 17 th National Congresses of the Party,China has stepped up the construction of social credit to an important strategic position.The two major credit systems,disciplinary punishment and trustworthy incentive,are an important part of the social credit system.Credit order has become an important guarantee for the development of the market economy and the healthy operation of society.In order to improve the construction of China's social credit system and maintain a good credit order,it is indispensable to punish various subjects for dishonesty."Discipline for dishonesty" was first mentioned in government documents,and then repeatedly used as a proper term,referring to the behavior of punishing dishonesty.Administrative agencies use disciplinary punishment measures to deal with discredited behaviors to achieve the purpose of administrative management.This article discusses the disciplinary punishment measures made by administrative organs.With the development of science and technology,information transmission is getting faster and faster,and big data is widely used.Due to its simple application,low law enforcement cost,and obvious effect,it is more and more respected and trusted by administrative agencies.The current administrative organs' use of disciplinary punishment measures to regulate untrustworthy behavior is applicable to various fields such as food safety,environmental protection,safe production,and product quality.Various departments and regional administrative agencieshave promulgated the "Joint Penalty Cooperation Memorandum" and related guidance and implementation measures to actively explore new content and new methods of penalties for dishonesty in practice.At present,the academic research on disciplinary punishment is gradually deepening,but most of them are started from aspects such as food safety,environmental protection,financial supervision,etc.More research is on the application of the system of disciplinary punishment,and a smaller part focuses on the operation of disciplinary punishment.Problems such as insufficient legal basis,unclear subjects and procedures,insufficient relief,etc.,and these problems often lead to infringement or violation of the rule of law.Therefore,it is indeed necessary to discuss various problems that may occur in the course of disciplinary action from the perspective of legal regulation.On the basis of clearing the background and significance of the implementation of disciplinary punishment,this article summarizes the practical situation of relevant provinces and cities by analyzing the current situation and problems of the legal regulation of disciplinary punishment in China,and compares the relevant systems of disciplinary punishment in foreign countries,in order to put forward suggestions to improve the legal regulation of disciplinary punishment in China.
