The labor dispatch is a new form of employment relationship, which separates the laboremployment from labor using. It is booming because of its advantages, for example, it canincrease employment opportunities, it have highly flexibility and can reduce labor costs. Inorder to make the labor dispatch be healthy, our country have made a series of laws andregulations, like the Labor Contract Law, the Regulations for the Implementation of the LaborContract Law and the Interim Provisions on Labor Dispatch, they all have rules to regulate andmanage the labor dispatch, but they dose not cure once and for all. The labor dispatch systemstill have some flaws, the legal loopholes still exist, reverse labor dispatch has not beeneffectively curbed, trans-regional labor dispatch have some abuses, the dispatched workers arenegative in working. These problems will damage the interests of dispatched workers, thenaffecting the development of harmonious labor relations. Therefore, this paper try to study theChinese labor dispatch system and analyze its faultiness, learn from foreign labor dispatchsystems, then put forward some opinions on how to perfect the labor dispatch system, weshould perfect the laws and regulations of labor dispatch, give full play to the governmentfunction, try to improve the social security system quickly and improve the legal status ofdispatched workers.In addition to the introduction and conclusion, this paper is divided into four parts.The first part is the basic theory of labor dispatch. This paper will take a comprehensiveoverview of the basic theory like the concept of labor dispatch, the emergence anddevelopment, impact on the traditional labor protection system and legal nexus, to have a basicunderstanding of labor dispatch.The second part is the introduction of foreign labor dispatch system. By analyze thedeveloped labor dispatch systems from developed countries’ like America, German and Japan,provide reference to perfect the labor dispatch system in China.The third part is the analysis of the existing problems of Chinese labor dispatch system.By elaborating existing problems of Chinese labor dispatch, try to analyze the problemsin labor dispatch legal laws and regulations, reversed labor dispatch, trans-regional labordispatch and dispatched workers’ employment psychology. Then find the reasons of these problems.The fourth part is to perfect the labor dispatch system in China. In view of problems fromour country’s labor dispatch system, on the base of learning foreign advanced systems. Thenput forward some suggestions to improve the labor dispatch system, for example, we shouldperfect the laws and regulations of labor dispatch, give full play to the government function,try to improve the social security system quickly, improve the legal status of dispatchedworkers. From these aspects, make the labor dispatch have a orderly developing in China.
