Nowadays the business environment of commercial banks changes dramatically and the competition in the industry is fierce. If the commercial banks want to maintain a good development situation in the market, they must focus on improving their own operating efficiency to adapt the unprecedented market changes.According to the Theory of Morden Property Ownership, the property right structure is the core of the analysis of the enterprise basic problems and the design of the enterprise reform, which plays a crucial and decisive role in the management efficiency of enterprise. Therefore, studying on the influence of the property right structure of commercial banks on performance is important to commercial banks adjusting their property right structure, perfecting corporate governance mechanism and improving business performance. This paper takes 18 commercial banks as the research object.By using the related data from 2009 to 2016,this paper studies the influence of property right structure on commercial banks under the current situation. It is expected to provide a theoretical reference for our commercial banks to improve their performance and play an important role in promoting economic development. On the basis of summarizing and combing the related research results, this paper use DEA model to make a comprehensive measurement of commercial banks'performance in the first. And the results show that the overall business performance of commercial banks in China present a trend of first decreasing and then rising, and then decreasing and then rinsing. In addition, the business performance of different types of commercial banks appear the same trend as the overall business performance of the industry. Moreover, based on the Tobit model, combined with the existing relevant theoretical studies, the paper selects state-owned property rights, foreign property rights, property rights concentration, transaction costs and other variables to build a model for the empirical research. The results show that the effect of different property rights on business performance of commercial banks is different. There is a significant positive correlation between state-owned property rights and commercial banks' business performance. The relationship between foreign ownership and commercial banks is also positive, but it is not significant; In addition,The relationship between the concentration of property right and the business performance of commercial banks is inversely U-shaped,which means that with the increase of the degree of property right concentration, the performance of commercial banks also increases. However, when the degree of property right concentration continues to increase and exceed a certain range, the performance of commercial banks decreases; The transaction costs of property rights and commercial banks' business performance present a significant negative correlation according to the result. In view of the analysis results, the paper puts forward some suggestions from the angle of establishing modern property right system, diversifying property right structure, reducing property right concentration degree moderately, perfecting incentive and restraint mechanism, and realizing effective incentive of property right.
