Since the proposal of the Belt and Road initiative,China 's OFDI scale has continued to expand to countries along the Belt and Road initiative. At the same time,China 's direct investment in Belt and Road countries has become increasingly affected by the protection of intellectual property rights in host countries. The impact of One Belt One Road national intellectual property protection on OFDI in China is of great significance.Generally speaking,China 's direct investment in countries along the Belt and Road scale is relatively small, and its regional distribution is uneven. At the same time,China 's direct investment in countries along the Belt and Road is expanding, and the investment industry is becoming more diversified. With regard to the level of intellectual property protection in the Belt and Road countries, the level of protection is generally low due to economic development restrictions.By browsing and sorting out relevant research literature at home and abroad, first, the influencing factors of foreign direct investment are described;secondly, the impact of the host country 's intellectual property protection mechanism on the OFDI behavior of the investing country is analyzed from a theoretical level, and the relevant models are set,And interpret the research results;again, describe the status of China 's direct investment in the “Belt and Road” countries and analyze the status of IP protection in the “Belt and Road” countries using the Intellectual Property Protection Index in the Global Competitiveness Evaluation;finally,Conduct an empirical test to analyze the impact of the Belt and Road national intellectual property protection level on China 's OFDI by constructing a fixed-effect model and a dynamic stepwise regression model. The empirical results show that among the countries along the Belt and Road,OFDI in China still prefers countries with good protection of intellectual property rights, which can give full play to the advantages of more corporate property rights, and at the same time reduce the problems of patent imitation and patent leakage. For developing countries with low levels of protection, their abundant labor force elements can make up for the lack of protection of intellectual property rights to a certain extent, which is still attractive to OFDI in China. On the basis of the above theoretical analysis and empirical testing, and based on the implementation background of the Belt and Road initiative,it puts forwardrecommendations for the optimization of the national intellectual property protection system and strengthens the protection of intellectual property rights and levels to increase the attractiveness of China 's OFDI.At the same time,Chinese companies should also make targeted decisions and choose direct investment in One Belt,One Road countries that are suitable for intellectual property protection.
