Impacts Of Stability Of Land Management Right On The Farmer Household's Behavior For Farmland Transferring

Since the implementation of the household contract responsibility system,China has carried out continuous reform on the farmland property right system,and granted farmers clear land contract and management right through the confirmation and certification of farmland right,but not legally granted farmers the right to trade contracted land.As the most important factor of production in agricultural production,land management right has not formed an effective trading market,and large-scale operation is difficult to achieve.In order to expand the production of apples,apple farmers mainly transfer farmland into farmland during the farmland transfer,and large-scale operation is very important for apple farmers to achieve economies of scale.How to realize the large-scale operation of agriculture and form the mechanism that the market plays a qualitative role in the allocation of agricultural factors has become an important issue of academic concern.From the perspective that the clarity of property rights can promote the occurrence of market transactions,the "three rights division" of rural land can improve the expectation of the stability of rural land property rights,so as to enhance the willingness of rural land transfer and promote the behavior of farmland transfer.Based on Coase theorem and public domain theory as the instruction,but so do Shaanxi and Gansu in apple's advantages in the loess plateau region in apple growers survey data as an example,through literature and theoretical analysis,explains,"separation of division" how to strengthen the land management of rural land,the land management of stability is how to affect the apple growers into farmland intention and behavior).First of all,the confirmation of farmland rights will enhance the stability of land management rights.Secondly,the enhancement of the stability of land management rights will affect the operation mode of property rights and promote the occurrence of market transactions.Finally,apple farmers are given the right to trade,which will affect their willingness and behavior to move into farmland.Based on this,the author deduces such a theoretical framework: confirming farmland rights--increasing the stability of land management rights--property rights operation--trading rights--farmland transfer willingness and behavior.The main research conclusions are as follows:(1)The enhancement of the stability of land management rights can effectivelyenhance the willingness of apple farmers to transfer to farmland and promote the conversion of apple farmers to farmland.(2)Compared with only completing the farmland confirmation and registration work,the influence and effect of farmers obtaining the farmland confirmation certificate on the stability of land management property rights are better.This indicates that the issuance of rural Land Contract and Management Right Certificate has better enhanced apple farmers' expectation of the stability of land management right from the legal perspective.(3)The aging trend of apple growers in the dominant areas of the Loess Plateau is obvious,which significantly negatively affects the willingness and behavior of apple growers to transfer to farmland.(4)Family location factors have a significant impact on the willingness and behavior of apple growers in farmland transfer.In view of the above research conclusions,this paper starts with the relationship between the stability of land management right and the willingness and behavior of apple farmers to transfer farmland,and puts forward several Suggestions:(1)complete the elimination work of farmland right confirmation,registration and certification as soon as possible,among which the issuance of rural land contract and management right certificate for farmers with right confirmation should be mainly implemented.(2)The Third Session of the 13 th National People's Congress adopted the Civil Code,which defines the contracted management right of land as usufruct.It also stipulates that if the term for the transfer of land management right exceeds 5 years,the applicant may apply to the registration organ for the registration of land management right.Local governments at all levels shall fully cooperate with the central government in promoting the confirmation and registration of land management rights throughout the country,and publicize and promote the confirmation and registration of land management rights in rural areas.(3)Improve the effectiveness of farmland property right market and attract young and middle-aged labor force to return to their hometowns to develop apple industry in accordance with the policy of cultivating new agricultural operating entities.
