| This thesis examines the plight of restaveks, child domestic servants in Haiti. Although this practice has garnered international attention in recent years, the Haitian government fails to confront this abusive system. Part I introduces the restavek system through the eyes of Jean-Robert Cadet, depicting his life as a former restavek. Children, like Jean-Robert, are sent to labor for host families who promise food, shelter, and education in exchange for their services. In reality, however, restaveks suffer physical, psychological, and sexual abuse. Part II examines Haiti's origin as a French colony and nation of slaves. Despite this tumultuous past, however, the Haitian government permits the restavek system to thrive. This section discusses the economic and social causes of the practice as well as its origin. Last, this section explores the broken promises and abuses these children face. Part III examines Haiti's efforts, or lack thereof, to confront the restavek system. This section critically evaluates Haiti's Constitution, Labor Code, and related laws. Despite its prohibitions against child slavery, Haiti has proven ineffective in abolishing the system. Rather, Haitians regard the restavek system as an acceptable, cultural practice. Part IV discusses the international response of non-governmental organizations and examines the International Labour Organization and the United Nations' Committee on the Rights of the Child as possible solutions. This section explores why each, alone, cannot adequately address the restavek system. Part V analyzes the Organization of American States and its ability to insist upon change at the regional level. Part VI concludes by advocating for an end to the restavek system, summarizing why the Organization of American States provides the best avenue to protect these children. |
