Using a collection of articles as a narrative frame, this position paper explores the history, background and effectiveness of Civil Commitment legislation for violent sexual predators. Through a careful review of the scholarly literature on research of state laws and recidivism rates, this paper will study the effectiveness of confining a violent sexual predator once he or she has completed their jail or prison sentence. In addition, this paper will provide an in-depth study of how the Due Process Clause, Double Jeopardy Clause, and the Necessary and Proper Clause, to assess whether or not civil commitment law violates the constitutional rights of an offender. |
