Abstract/Summary:
The weak Albanian government has so far failed in fulfilling the population's housing needs, leaving the burden of this important endeavour to private enterprise. These conditions have made more evident the dire need for the development of a mortgage financing market. Undoubtedly, this is inextricably linked to the existence of a functional system of mortgage security enforcement, which has been identified by many analysts as the most important factor in encouraging or discouraging mortgage finance.;Throughout this thesis, research and considerable emphasis has been placed on the need for a varied, expeditious, efficient and inexpensive system of mortgage remedies in Albania that will function as well as some corresponding systems in the West.;A section of this thesis has been devoted to a comparative analysis of Canada's legal framework of mortgage remedies with that of Albania. After an examination of the major deficiencies in the current system of Albania, proposals for improvements have been made using the commonly accepted criteria for an effective system of mortgage enforcement. In conclusion, given the need for deep and substantial reforms to Albania's Judgements Enforcement Institutions, as well as taking into account Albania's specific conditions, the adoption of new methods of realization of the security it is recommended.
