The law of foreign investment in China: A critical analysis

Abstract/Summary:
Given the length of Chinese history, there exist unfavourable factors for foreign investment in China. Hence, the thesis reviews historical barriers to foreign investment. These barriers mainly refer to China's bitter experience of foreign business relations in the recent past and lack of legal tradition in China. Further, the thesis discusses unfavourable climate for foreign investment resulting from ideological constraints imposed by the Chinese Communist Party.;Finally, the thesis summarises the legal analysis. Also, the thesis presents a comparison of advantages and disadvantages of different investment vehicles available in China and investing in different parts of China. The thesis concludes that the current legal climate for foreign investment is generally favourable in China, but the political system does not guarantee that this trend is to continue. (Abstract shortened by UMI.).;The major portion of the thesis discusses different statutes which directly govern foreign investment. Three chapters cover different business forms available for foreign investors contemplating doing business in China. Each legal regime is analyzed in depth; the defects of each legal regime are also highlighted. The last chapter analyzes regional incentives for foreign investment.
