Research On The Legislative Regulation Of The Application Of Human Gene Editing Technology

In 2018,the event of editing babies with gene technology has caused widespread controversy in academic and practical circles around the world.Since its application,great progress has been made in medical and agricultural fields,and has made contributions to the survival and development of human beings around the world.People cheered for technical achievements,and the occurrence of editing baby incident also caused panic.Whether the application of new technologies is too tolerant,whether the application of gene technology to edit human genes violates the management norms of clinical technology application field in the world;what potential risks will be caused by the application of gene editing technology;what efforts should the law make to regulate the risks caused by the application of technology.Gene editing technology has appeared early.The research level of gene editing for human embryo is earlier and mature than that in China.However,the editing baby event happened in China.Is it a coincidence or inevitable? Does it reflect the major problems in the national law and legal supervision from the aspect.If so,how to solve it.At present,China lacks clear technology application boundaries,and the relevant legislation on the protection of rights is in a blank state.The public lacks awareness of the risks that gene technology application or will bring,and the responsibility for violating the rules of technology application is not specific.The earlier application of gene editing technology abroad,the corresponding legislative regulation measures are also more perfect.Through the study of foreign legislation norms combined with the current situation of technology application in China,the author puts forward suggestions for the improvement of the current legislative regulation in China,and promotes the development of scientific and technological standardization.This paper is divided into five parts,The first chapter is about the problem.Through a brief introduction of the development of gene editing technology,the event of gene editing baby caused widespread controversy in the academic field.Therefore,the author puts forward several main research issues,explains the significance of the study,combs the research situation at home and abroad,summarizes the research methods and research ideas and Innovations Adopted in this paper.The second chapter mainly defines the meaning,characteristics,application value and application status of gene editing technology,summarizes the application field of technology,and then analyzes the ethical,technical,rights protection and differential risks in the application process,and explains the necessity of legislative regulation from the application risk and application limits,and how to regulate it.The third chapter introduces the current situation of legislation in regulating the application of gene editing technology in China.It lacks special legislation.It needs to analyze the shortcomings from the department law,and analyzes it from three aspects: criminal law,administrative law and civil law.Chapter four,through the investigation of the application of human gene editing technology in the outside of the legislative regulation mode,combined with the actual situation to draw inspiration to China.The fifth chapter is to introduce the legislative improvement suggestions on regulating the application of human gene editing technology.In view of the problems,the author makes suggestions from the perspective of criminal law,administrative law and civil law to set up responsibilities,so that the application of gene editing technology can develop healthily and benefit the cause of human medicine.
