The Special Legislation Research On Air Pollution Prevention And Control Of The Beijing-Tianjin-Hebei Regional

At present,the air pollution of Beijing-Tianjin-Hebei regional is extremely serious and presents the typical regional and compound features.The traditional control methods based on administrative divisions can no longer effectively control regional air pollution.Since Beijing-Tianjin-Hebei regional is one of the key areas for prevention and control air pollution,china government has issued a number of policy documents to guide the governance of this region' air pollution.At the same time,Beijing,Tianjin and Hebei are also actively conducting joint prevention and control.However,the implementation effect of policy documents is short-term and not obvious.Therefore,it is necessary to establish long-term prevention and control mechanisms through legislation.At present,the laws and regulations of regional air pollution prevention applicable to Beijing-Tianjin-Hebei regional are mainly include the Environmental Protection Law,the Air Pollution Prevention and Control Law,and the Air Pollution Prevention Regulations of Beijing,Tianjin and Hebei.However,these laws and regulations have the following problems: The legal provisions are over-principle,lack of regulations of regional environmental management,the prevention and control systems are inadequate,and the implementation of responsibilities are also unclear.Therefore,carry out legislative research on the air pollution prevention and control of Beijing-Tianjin-Hebei regional and solve the legal problems existing in the joint prevention and control mechanism is of great significance.This article consists of five chapters.The content is as follows: The first chapter is the introduction.This section firstly analyzes the air pollution situation and the policy and legislative situation,and put forward the main content of this paper.Secondly,introduces the domestic and foreign research status of regional air pollution prevention and control.Finally,explains the research methods and innovations of this paper.The second chapter describes the legislative foundation of the Beijing-Tianjin-Hebei air pollution prevention and control.Mainly from four aspects including the basic concepts,mode selection,necessity and feasibility to discuss the basic theoretical issues.The third chapter analyzes the regional air pollution control laws and regulations that Beijing-Tianjin-Hebei regional can apply,and analyzes existing legal issues.The fourth chapter studies the practice of preventing and controlling regional air pollution in foreign countries,such as South Korea,Japan,the United States,and the European Union.It mainly analyzes the legislative experience,the establishment of regional environmental management agencies,the joint prevention and control legal system,and the implementation of responsibilities,expected to provide experience for the Beijing-Tianjin-Hebei region's air pollution governance.On the basis of the foregoing analysis,the fifth chapter proposes the formulation of Beijing-Tianjin-Hebei air pollution prevention and control regulations.Around this regulation and targeted Beijing-Tianjin-Hebei regional,this paper suggest to clarify the regional prevention and control legislative principle,set up regional environmental management mechanism,improve regional prevention and control legal system and strictly implement joint governance legal responsibility.
