Research On The Environmental Legal System Of The Regional Joint Prevention And Control Of Pollution Prevention

Economic development and environmental pollution interacts with each other.For survival environment,people have experienced such a stage:from the unconscious period of fear of nature to conscious voluntarily protect phase,and then to protect actively with decrees.The pollution stimulates people to protect the environment.Reform and open up the Chinese economy for nearly forty years,the environmental pollution problems are getting worse.The environmental pollution's features include regional,multipurpose,structural,compressible and global.Regional pollution prevention and control is very important.The prevention and control of China's regional air pollution creates the traditional environmental management system.The new system was put into practice firstly,and then the government formulated and executed relative laws.It has experienced three stages from "regional exploration practice" to "national standard document planning guidelines",and to "comprehensive promotion of laws and regulations".Latest Implementation of "Environmental Protection Law" and the latest revision of "Air Pollution Prevention Law" established a coordination mechanism for regional joint prevention and control of air pollution.But for the lack of special legislation,Local protectionism,unconsummated related systems and so on,its legal mechanism has some problems in subject mechanism,enforcement measures,interest balance,information sharing and deliberative democracy.Therefore,it is necessary to perfect the legal mechanism at the regional joint prevention and control of air pollution under the premise of international experience and domestic practice and reform of ecological civilization.This article is divided into four chapters to analyze the problem for the legal mechanism at the regional joint prevention and control of air pollution and propose solutions.The main content of the first chapter is the summary of the basic theory of the joint protection and control containing concept,system value and theoretical basis.The mechanism combines regional management with administrative management to improve the effectiveness of pollution control.The theory of public goods,external diseconomy and ideas of sustainable development provide theoretical supports for the mechanism..The main content of the second chapter is the system's formation and problems at institutional level in our country.This chapter details five aspects such as control body,prevention and control measures,balance mechanism of interest,public participation and restriction mechanism.The main content of the third chapter is the institutional requirements in US and EU,plus the comment both of them.The experience of regional pollution control in the United States and the European Union provides a useful reference for our country.The main content of the fourth chapter is the perfection methods of the system.The question of the system of the second chapter is answered in this chapter.On the subject of control,compare with the regional administration set up by the ministry of environmental protection,and the regional management center reformed by environmental supervision centers.On control measures,learn from "common but differentiated responsibilities",allow for flexible security lines,set up a regional sharing platform about monitoring information.On interest balance mechanism,increase the fund system of pollution prevention and control and the system of environmental liability insurance.On public participation,underline decision-making.On constraint mechanism,introduce regional restrictions.
