Research On Implementation Mechanism Of Inter-provincial Environmental Pollution Cooperative Governance Administrative Agreements

Inter-provincial environmental pollution cooperative governance administrative agreements are singed by equal inter-provincial governments because they want to solve environmental problems in the process of regional integration.The problem of environmental pollution is a cross-regional systemic problem.The traditional single administrative division can no longer effectively deal with the problem of cross-regional environmental pollution.The Yangtze River Delta,the Pearl River Delta and the Beijing-Tianjin-Hebei region have frequent problems of cross-regional environmental pollution.In order to better solve the problem of inter-provincial environmental pollution,inter-provincial environmental pollution cooperative governance administrative agreements become a new type of environmental governance tool.At present,inter-provincial environmental pollution cooperative governance administrative agreements is mainly carried out in the form of administrative agreements.Practice has proved that inter-provincial environmental pollution cooperative governance administrative agreements can solve environmental pollution effectively.Inter-provincial environmental pollution cooperative governance administrative agreements are composed of the principles of performance,basis for performance,method of performance,liability for breach of contract,dispute resolution,and performance-supervision.The implementation mechanism of agreements explore in terms of implementation subjects,implementation procedures,and implementation methods and achieve good results.However,there are still some problems in the implementation of the administrative agreement,such as the lack of integrity of provincial governments,the non-standard agreement terms,the lack of dispute settlement mechanism and the lack of supervision mechanism.The implementation mechanism of cross-regional administrative agreements between the US governments obtain good experience.For example,they try to establish relatively complete agreement clauses,set up administrative agreement performance agencies,improve administrative agreement dispute resolution mechanisms and establish administrative agreement implementation supervision mechanisms.The experience in the construction of the implementation mechanism of the cross-regional administrative agreement between the US governments provides a reference for the improvement of the implementation mechanism of inter-provincial environmental pollution cooperative governance administrative agreements in my country.Through learning from the useful experience of the United States,I try to propose a path to improve the implementation of agreements.The first is to build an inter-provincial government’s self-consciousness system.The second is to improve the terms of the inter-provincial cooperation administrative agreements.The third is to establish a diversified dispute resolution mechanism and the fourth is to establish a supervision and restraint mechanism.
