Protection And Improvement Of Ecological Legal Interest By Criminal Law

With the continuous development of the society,the concept of legal interest is becoming wider and wider.Since the middle of the 20 th century,various risks have emerged,among which environmental risks are the most urgent.At this time,ecological interests have gradually become the interests generally protected by law in order to achieve sustainable development of the environment.The original concept of legal interest cannot be separated from the association of "interest".The development of ecologism has gradually influenced the traditional criminal law theory,and the ecological legal interest has become the legal interest concerned by criminal law.How to combine the ecological legal interest with the basic theory of criminal law to form the criminal protection theory of ecological legal interest in China is the key and difficult point.Therefore,it is necessary to define the concept category of ecological legal interest,and conduct a categorization analysis of the legal interest of related environmental crime offences according to the Criminal Law of China,and adjust the contradictions and conflicts between different legal interest protection,so as to adjust the structure of ecological legal interest in China to be more suitable for the current environmental criminal policy.At the same time,this paper summarizes the problems existing in the process of ecological law interest protection in China,such as the lack of legislative principles and ideas,the narrow scope of protection objects,and the single type of crimes.In addition,for the world’s major countries is introduced,the present situation and problems of environmental criminal legislation policy and the environment criminal activity legislation and the concept of crime Settings,and so on were analyzed,and be conducive to the development of our country environment criminal activity legislation,and through these measures to supplement and perfect our country environment criminal activity legislation,in order to construct the reasonable framework of the theory of ecological law benefit of criminal law in China.
