Research On The Relation Between Contract Reference Point,Fairness Perception And Contractor’s Performance Behavior

With the continuous updating and upgrading of the construction industry,EPC,PPP and other integrated development and contracting modes emerge as the times require.The starting point of the integrated development and contracting mode is "overall planning and integration",through the integration of various stages of the project to achieve the purpose of project efficiency and cost reduction.However,the key to achieve the goal of increasing efficiency and reducing cost is to enable contractors to choose positive performance behaviors that are conducive to the overall performance of the project.With the development of the contract reference point theory,the psychological and behavioral factors are introduced into the incomplete contract theory.It is recognized that the behavioral factors among the contracting parties are also important means to achieve incentives.Following the behavioral analysis approach of the contract reference point theory,the contract reference point theory is introduced into the field of construction.The choice of the contractor’s performance behavior will be affected by the initial contract,so the initial contract has an important impact on the contractor’s performance behavior.Based on the existing research,this study constructs a conceptual model between the risk liability clause,one of the equity concerns in the initial contract,and the contractor’s performance.On this basis,the contractor’s fair perception is introduced to open the black box of the project contract reference point effect on its performance.At the same time,the risk compensation quota as the external reference point is introduced as the moderating variable of the impact of the contract reference point on the contractor’s fair perception,and the clause clarity is introduced as the moderating variable of the impact of fair perception on the contractor’s performance.The research hypothesis of the relationship between the reference point of Engineering contract,fair perception,contractor’s performance behavior,risk compensation and clause clarity is put forward,and the conceptual model is constructed.This research is based on the cooperation of consulting companies or real estate development companies in Tianjin,Beijing,Guangxi,Yunnan,Wuhan,Hebei and other regions,as well as cooperative construction units.Finally 343 valid questionnaires were obtained.Smart PLS 3.0 statistical software was used to test the hypothesis.Empirical evidence proves that:(1)reasonable allocation of risk responsibility has a positive inductive effect on contractor’s performance;(2)risk responsibility has a positive role in promoting fair perception,while risk compensation has a positive regulatory role between risk responsibility and fair perception;(3)fairness perception plays a positive role between risk responsibility and contractor’s performance behavior.Mediating effect;(4)Fairness perception has a positive role in promoting performance,and clarity of clauses plays a moderating role between fair perception and literal performance,but has no moderating effect on fair perception and perfect performance.The research results reveal the influence mechanism of contract reference point on contractor’s performance behavior.It improves the basic position and realistic explanatory power of contractors(agents)in the theoretical system of project governance,which also means that it opens up a new path of "reference point-fair perception-performance induction" for the improvement of project performance.In addition,the research results also expand the research of contract governance.The results show that both clarity of terms and risk liability terms can promote the contractor’s literal performance,which also shows that contract governance depends not only on the integrity of contract content,but also on the structure of contract.The nature of these integrated development contract models is to achieve the project value increment in the whole life cycle by utilizing the professional competence of the general contractor.However,only when the contractor provide the performance that is conducive to the overall project,can the project achieve value increment? Thus,the key to achieve value increment is the choice of contract performance behavior.
