Research On EPC Project Contract Management

International Association of Consulting Engineers(FIDIC)in 1999 formulated the design,"procurement and construction(EPC)/ AC key project contract conditions "(namely " silver beige book "),in recent years,under the environment of the rapid development of economy in our country,construction field is becoming more and more prosperous,the size and number of construction projects also rapidly expanding,EPC mode in the trend of the development of C hinese construction industry favored.Different from C hinese traditional construction or design general contracting mode,EPC project,the general contractor comprehensive contract the engineering design,materials and equipment procurement,construction,operation and maintenance,etc.,also on the project quality,safety,construction,environmental protection,communication and coord ination is responsible for.In the EPC project construction period,due to the design,procurement,construction of the work of the depth of the cross and fully coordinated,can achieve a short period,to ensure quality,cost savings and other purposes.But because of the EPC project of large scale,long construction period,relates to the complexity of the,practice reflects the general contractor of the project management ability is insufficient,contract management as the core of the project management bear the brunt,the performance of the contract period PinChu condition.Based on the full reading of related literatures at home and abroad,books,using the system analysis method,case analysis method,analysis of the EPC project in advance and development in C hina,pointed out that in the general contractor's position on contract management in EPC project management in the core role,then the theory this paper introduced from three aspects of EPC engineering,engineering project management,EPC project contract,and then perform EPC management,project management,contract dispute EPC engineering contract risk management three aspects focus on the EPC project contract management from the EPC project contract,at the end of this paper the research content of Tianfu Central Park(a)project analysis.In this paper,the main conclusions are: the main content of management performance of combing EPC project contract,analysis of Chinese current EPC project contract management of the status quo,aiming at the e xisting problems,put forward the general contractor should from contract disclosure,contract managers' professional quality,strengthen the management of sub contractors and other aspects to strengthen contract management work;through the characteristic s of the EPC construction contract dispute consequence and cause of the statement,according to the current situation of our country to solve the EPC contract dispute,pointed out that the friendly consultation and friendly attitude is the most effective way to solve the dispute of the contract,both parties can through timely communication,appropriate concessions,to make full use of informal the discussion,based on the practical attitude and other ways to promote friendly negotiation between the two par ties,to reduce the losses caused by disputes;Through the EPC project contract risk management present situation analysis,while taking into account the EPC general contractor in the contract management work in the intervening time much earlier in the traditional mode of general contract.In this paper,the contract risk management stage division of the not constrained in the contract performance period and to extending from the anterior to the contract signed early.Also extends back after the completion of the contract risk management evaluation stage.In addition,the paper puts forward that the general contractor can improve the risk management level of the contract from several aspects,such as the importance of the contract review,the strict control of the contract terms,and a thorough understanding of the requirements of the owner.For the general contractor,the contracting EPC project is equal to the benefits and risks.Earnestly do a good job in the EPC project contract management,can effectively improve the project management level,reduce the risk and guarantee income;contribute to the general contracting enterprise considerable development;promote the mode of EPC project in C hina is becoming more and more mature,and promote the development of Chinese construction market healthy and orderly.
